1. Introduction
Welcome to the Tenancy Caution Fee (TCF) platform. By accessing or using this website, you accept these Terms and Conditions, which form a binding agreement between you and Havendus Management Services Ltd ("we", "us", "our").
These Terms govern your access to and use of the TCF platform for managing tenancy caution fees, dispute resolution, and tenancy verification services. If you do not agree to any part of these Terms, please discontinue your use of the platform.
2. Definitions
- “TCF” – The Tenancy Caution Fee platform, a digital solution for managing rental caution deposits securely.
- “User” / “You” – Landlords, tenants, estate agents, property managers, and other registered platform users.
- “Caution Fee” – A refundable sum paid by a tenant to be held for the duration of the lease to cover possible damages or violations.
- “Account” – The segregated account within the TCF platform where caution fees are securely held during tenancy.
- “Havendus” – Havendus Management Services Ltd, the registered operator of the TCF platform.
3. Eligibility and User Registration
To use the TCF platform, you must:
- Be at least 18 years old
- Provide accurate and verifiable personal details
- Be a legal party to a tenancy agreement (as tenant, landlord, or authorized agent)
You are responsible for maintaining the confidentiality of your account credentials and all
activities conducted under your account.
4. Website Usage
By using the TCF website, you agree to:
- Provide only truthful and lawful information
- Refrain from uploading or distributing viruses, malware, or harmful content
- Not impersonate other individuals or entities
- Use the platform only for its intended lawful purpose
Any abuse, fraudulent activity, or manipulation of the platform will result in account suspension
or legal action.
5. Platform Services
The TCF platform enables:
- Collection and safe custody of tenancy caution fees
- Automated refund and release mechanisms
- Online dispute resolution between landlords and tenants
- Access to tenancy records and payment history
- Regulatory-compliant tenant verification and data management
6. Caution Fee Payment & Holding
- All caution fees must be paid through the official channels on the TCF website or web app
platform.
- Funds are held in a segregated account under Havendus Management Services Ltd until tenancy
termination.
- The tenant and landlord are both notified of the receipt and status of payment.
- Caution fees do not accrue interest.
7. Refund Policy
At the end of tenancy, caution fees may be:
- Fully refunded to the tenant upon confirmation of satisfactory handover;
- Partially or fully disbursed to the landlord if damages, rent arrears, or breaches are
proven;
- Temporarily withheld if there is an active dispute pending mediation or documentation.
Refund Process:
- Requests must be submitted through the platform within 30 days of tenancy termination.
- Refunds are processed within 7–14 business days, subject to dispute clearance.
- Administrative or transaction fees (where applicable) are non-refundable.
8. Dispute Resolution
The TCF platform offers a structured process for resolving landlord-tenant disputes related to:
- Damages
- Unpaid utility bills
- Unauthorized deductions or non-refund of caution fee
Parties must submit relevant documentation (e.g., tenancy agreement, photos, inventory reports).
TCF mediators will review and issue a resolution. If unresolved, parties may escalate
externally, but initial internal mediation is required.
9. Data Protection & Privacy
We are fully compliant with the Nigeria Data Protection Regulation (NDPR). By using our platform,
you consent to the collection and use of your data in accordance with our Privacy Policy, which
includes:
- Identity verification
- Regulatory compliance
- Service improvement
- Dispute resolution and lawful disclosures

10. Intellectual Property
All content on this website—including text, graphics, logo, platform design, and system
architecture—is the intellectual property of Havendus Management Services Ltd and is protected
under Nigerian copyright law. Unauthorized copying, redistribution, or modification is prohibited.
11. Limitation of Liability
While we ensure platform integrity and data protection, Havendus Management Services Ltd is not
liable for:
- Delays in fund disbursement due to inaccurate user input
- Technical issues outside our control (internet failure, third-party downtime)
- Damages resulting from misuse of the platform by users
Use of the platform is at your own risk.
12. Suspension & Termination
We reserve the right to suspend or terminate user access if:
- False or fraudulent information is provided
- Platform misuse or breach of these Terms is detected
- User fails to cooperate in a dispute or verification process
13. Fees & Charges
- TCF may charge administrative or platform usage fees, clearly disclosed at the point of
transaction.
- Fees are non-refundable once services are rendered (e.g., registration, mediation, or
disbursement processes).
14. Changes to Terms
We may update these Terms periodically. Users will be notified via email or platform alerts.
Continued use of the platform after changes means you accept the revised terms.
15. Governing Law
These Terms shall be governed and construed in accordance with the laws of the Federal Republic
of Nigeria. Any legal dispute shall fall under the jurisdiction of the courts of the State.
